1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the websites, software, and services provided by Sasware Softworks ("Sasware," "we," "us," or "our"). By accessing or using our services, purchasing licenses, or engaging us for consulting or penetration testing, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Eligibility

Our software tools may be used by individuals of any age provided they comply with these Terms and applicable platform rules. If you are entering into a paid agreement, purchasing a license, or engaging us for consulting or penetration testing services, you represent that you have the legal authority to do so—this means you are the age of majority in your jurisdiction or have obtained the consent of a parent, guardian, or authorized representative. You further represent that all information you provide to us is accurate, complete, and current.

3. Services

We design and deliver software solutions, including proprietary anti-cheat tools, developer utilities for Roblox, hosted services such as our Discord bot, and related APIs or integrations. We also offer custom consulting, penetration testing, and security assessment engagements. Certain offerings may be provided as free and open-source software, while others are proprietary and licensed.

4. Licenses and Usage

• Proprietary software is licensed, not sold. Your use is limited to the scope outlined in the applicable license agreement or order confirmation.
• Unless expressly permitted, you may not copy, modify, reverse engineer, decompile, redistribute, or resell our proprietary code, keys, or services.
• Open-source projects are governed by their respective licenses. You are responsible for complying with those terms.
• Licenses may include device, user, or environment restrictions. Attempts to bypass licensing controls are prohibited.

5. Payments and Refunds

Fees for proprietary software or consulting services are due as stated during checkout or in the applicable statement of work. All payments are processed through approved platforms. Refunds, if any, are governed by our Refund Policy.

6. Customer Responsibilities

• Provide timely access to systems, information, and personnel necessary for us to deliver services.
• Ensure you have the requisite rights and permissions to engage us for penetration testing or security assessments.
• Maintain the confidentiality and security of any credentials, API keys, or licenses we provide, including tokens used to authorize our Discord bot.
• Use our software in accordance with platform terms (including Roblox policies, Discord's Terms of Service, and community guidelines) and applicable laws.

Acceptable Use

You are solely responsible for the content and actions initiated through our services, including automated messaging, moderation, or logging performed by the Discord bot. You agree not to:

• Use the services to send spam, phishing content, or unsolicited commercial messages.
• Deploy the services to harass, threaten, or otherwise harm individuals or communities.
• Collect or process personal data through the services without a lawful basis or required notices.
• Misrepresent the purpose of the services or interfere with the normal operation of Discord or other third-party platforms.

7. Confidentiality

Both parties agree to protect confidential information shared during an engagement. We treat all client data, system details, and findings as confidential and use them only to deliver the contracted services, except where disclosure is required by law.

8. Intellectual Property

We retain all intellectual property rights in our software, deliverables, documentation, and methodologies unless expressly assigned in writing. Deliverables provided during consulting engagements are licensed for your internal use subject to any limitations set out in the engagement agreement.

9. Feedback

If you provide feedback, suggestions, or ideas, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate them without obligation to you, provided we do not disclose your confidential information.

10. Third-Party Services

Our services may interact with third-party platforms or tools, including Discord and hosting providers. We do not control third-party services and are not responsible for their actions, availability, policy changes, or terms. Your use of third-party services is governed by their terms and policies, and you must maintain any required accounts or permissions.

11. Security and Testing Limitations

Penetration testing, security services, and hosted offerings such as the Discord bot may involve inherent risks, including possible downtime, rate limiting, or data exposure. We exercise reasonable skill and care, but you acknowledge these activities cannot guarantee complete security or uninterrupted availability. Third-party outages or policy changes may affect service delivery. You are responsible for backing up data, maintaining contingency plans, and promptly revoking credentials if you suspect compromise.

12. Disclaimer of Warranties

Our services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or our services (including automated actions taken by the Discord bot or other integrations) is limited to the amount you paid to us for the service giving rise to the claim in the twelve (12) months preceding the event. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or data.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your use of our services, your breach of these Terms, or your violation of applicable laws or third-party rights, including claims related to content transmitted through the Discord bot or other automated workflows you configure.

15. Termination

We may suspend or terminate your access to our services if you breach these Terms or engage in misuse or unlawful activity. Upon termination, all licenses granted to you under these Terms will immediately end. Sections that by their nature should survive termination will continue in effect.

16. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a revised "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts located in Ontario, Canada, unless we agree otherwise in writing.
